Terms of Use

These Terms of Use ("Terms") are an agreement between you and Como Tesla ("the club", "we", "us"), the Tesla owners club for Columbia & Boone County, Missouri. They cover your use of comotesla.com (the "site"), your membership, and your participation in club events. By applying for membership, using the site or attending a club event, you agree to these Terms, our Privacy Policy and our Club rules. If you don't agree, please don't use the site.

1. Not affiliated with Tesla

Como Tesla is an independent, volunteer-run owners club. It is not affiliated with, endorsed by, sponsored by or operated by Tesla, Inc. "Tesla" and Tesla vehicle names are trademarks of Tesla, Inc. and are used only to describe the vehicles our members own. Club events are not Tesla events, and nothing on the site is advice from Tesla.

2. Eligibility and membership

• You must be at least 18 years old and own or lease a Tesla vehicle to apply.
• The information you give us must be true, accurate and your own. You may only submit a VIN or Tesla referral link for a vehicle you own or lease.
• Membership is free. Every application is reviewed by a club organizer, and the club may approve, decline or ask for more information at its discretion.
• "Verified Tesla Owner" status means the VIN or referral link you provided passed our checks. It is not a guarantee of vehicle ownership, and Tesla, Inc. alone decides whether the club receives official recognition.

3. Your account

You are responsible for keeping your password private and for activity on your account. Tell us right away if you think someone else has accessed it. Your digital membership card is for your personal use and may not be shared, copied or transferred.

4. Club rules and conduct

You agree to follow the Club rules and to treat other members and the public with respect. You must not:

• Provide false information, or submit a VIN or referral link that isn't yours.
• Harass, threaten or discriminate against anyone.
• Collect or share other members' personal information outside the club.
• Misuse the site, including trying to access accounts, data or areas you aren't authorized to, interfering with its operation, or sending spam.
• Present yourself as speaking for the club or for Tesla, Inc. without permission.

5. Events and assumption of risk

Club events such as meetups, group drives and Supercharger gatherings are organized by volunteers. Attending is voluntary. By attending or participating, you agree that:

• Driving and attending events involve risks, including traffic accidents, vehicle damage, property loss, personal injury and death. You voluntarily accept these risks.
• You are solely responsible for your own vehicle, your driving, your passengers, your guests and your belongings.
• You will obey all traffic laws, posted rules of event locations and the instructions of event organizers. Street racing, reckless driving and driving under the influence are never permitted.
• You will carry the vehicle insurance and valid driver's license required by law whenever you drive to or at a club event.
• Event locations, such as charging sites and businesses, are owned and run by third parties, and their rules and terms apply.
• We may change, postpone or cancel events at any time.

To the fullest extent permitted by law, you release Como Tesla, its organizers and volunteers from claims arising out of your attendance at or participation in club events, except claims caused by their gross negligence or willful misconduct.

6. Ending membership

You may close your membership at any time by contacting us. We may suspend or end a membership, or remove someone from an event, if they break these Terms or the Club rules, give false information, or put others at risk.

7. The site

The site and its content, including the club name, logo and design, belong to the club or its licensors. You may use the site only for your personal, non-commercial participation in the club. Links to other websites are provided for convenience, and we are not responsible for their content.

8. Disclaimers

The site, membership and events are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the site will always be available or error-free, or that event information is complete or accurate.

9. Limitation of liability

To the fullest extent permitted by law, Como Tesla, its organizers and volunteers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, property or profits, arising from your use of the site, your membership or club events. Because membership is free, our total liability for any claim relating to the site or membership is limited to one hundred U.S. dollars ($100). Some laws do not allow these limits, so they apply only to the extent the law allows.

10. Indemnity

You agree to defend and hold harmless the club, its organizers and volunteers from claims, damages and costs (including reasonable attorneys' fees) that arise from your breach of these Terms, your conduct at club events, or your vehicle, except to the extent caused by our own gross negligence or willful misconduct.

11. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Boone County, Missouri, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. If we make significant changes, we will update the effective date above and, where appropriate, let members know by email or on the site. Continuing to use the site or attend events after a change means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. These Terms, the Privacy Policy and the Club rules are the entire agreement between you and the club about the site and membership.
